The Gujarat High Court has introduced a policy banning the use of artificial intelligence in judicial decision-making, including drafting orders and preparing judgements, Bar and Bench reported on Saturday.

The policy applies to judicial officers, registry staff, legal assistants, interns and administrative personnel in the High Court and the district judiciary, The Indian Express reported.

It states that artificial intelligence cannot be used for any form of decision-making, judicial reasoning, drafting of orders, preparing judgements, considerations for bail or sentencing, or any substantive adjudicatory processes, even if the output is reviewed by a judge, Bar and Bench reported.

However, limited use of artificial intelligence is permitted to support functions such as legal research, translations, improving language in drafts and administrative work, The Indian Express reported. However, such outputs must be verified by a “qualified human officer”, the policy added.

It also prohibits entering confidential or personal case data into public artificial intelligence tools.

The policy says that artificial intelligence-assisted content, once signed, will be the responsibility of the person who has generated it and the usage of AI cannot be cited as a defence for errors or misconduct.

Violations of the policy will be treated as misconduct and may attract departmental or disciplinary proceedings under service rules, the policy added.
